Contracts commonly specify prospective time impact analysis (TIA) as the preferred or required method to support a request for time extension, and AACE Recommended Practice 52R-06 provides an eight-step procedure for implementing TIAs.Still, while parties to a contract often agree on the broad outlines of the approach, many are unable to negotiate time extensions contemporaneously due to disputes over the details. Common sources of dispute include the lack of acceptance of the underlying schedule updates, how to construct the delay fragnet, how to tie the fragnet into the schedule, and whether the durations for fragnet activities are reasonable. This presentation will provide guidance on how to resolve disagreements at each step of the TIA process to successfully negotiate a time extension.
