Alice in Wonderland: Amending Section 101 to Get Out of the Rabbit Hole - The time has come for Congress to consider legislation to clarify the law governing patent eligibility. Long a source of confusion, the Supreme Court's recent decisions on subject matter eligibility have introduced an new era of confusion with a common law framework that is at odds with the statute, cannot be easily administered by the PTO or the lower courts and, ultimately, risks under-investment in research and development.

The webinar will review the history of the statute and the case law, highlight problems with with the case law and its conflicts with the statute, and finish with a detailed consideration of possible changes to patent eligibility law and legislation for enacting them.
