Surviving Daubert in a Patent Case From the Perspective of a Financial Expert

In recent years, the courts have increased scrutiny of the factual underpinnings and the methodology used in damages opinions of financial experts in patent cases. The increased scrutiny has incentivized parties to more frequently challenge the opinions of financial experts under the Supreme Court’s Daubert decision and its progeny.
As we all know, presenting a damages case is often challenging even with an expert. Without an expert, it can be near impossible.

The Panelists for this CLE include a Federal District Court Judge, Financial Experts, an Outside Litigator and an In House Attorney. Through their combined experiences, they will suggest successful, proven strategies for preventing and surviving Daubert challenges.
