This session will review recent IP legislation efforts that may impact the value of patents and other IP. The session also will review the Federal Circuit’s Arthrex decision on whether the appointments of administrative patent judges (APJs) to the Patent, Trial and Appeal Board (PTAB) were constitutional, the current impact of that decision and potential legislative, regulatory or court remedies proposed to address the issue. The session will review practice tips for overcoming Section 101 patentable subject matter rejections during patent prosecution.
