AIA proceedings were designed to be a lower cost and faster alternative to district court litigation and there have been over 10,000 Petitions filed for Inter Partes Review (IPR), Post Grant Review (PGR), and Covered Business Method Review (CBM). Its counterpart, Oppositions at the EPO, have always been a cost effective way to attack a European patent centrally and in recent years have been the subject of a successful streamlining initiative. This presentation will cover the fundamentals of Inter Partes Review (IPR) proceedings and Oppositions at the EPO and provide a comparison of the two proceedings.
