Description

Course Description
On February 22, 2021, Illinois Governor JB Pritzker signed into law the Pre-Trial Fairness Act. The new law will abolish the use of cash bail in pretrial release decisions and goes into effect on January 1, 2023. This bill will also establish new processes for pretrial release and detention decisions, creates a state-wide system of pre-trial data collection, allows for citations in lieu of arrest, and other changes. This will be the first course in a series that will overview the work that the Illinois Supreme Court Pretrial Implementation Task Force is undertaking as Illinois moves toward the elimination of cash bail and other significant pretrial reforms. In addition, the faculty will also discuss the road to implementation.

  • Summarize the high-level changes brought about by the Pre-Trial Fairness Act
  • Identify the key issues that have come before the Taskforce and have an opportunity to provide feedback to the Taskforce

    Dan currently serves as the Assistant Director of the Administrative Office of the Illinois Courts (AOIC) – Probation Services Division.

    Prior to AOIC he served as the Director of Probation and Court Services in Peoria County. He started his career in Court Services in 2005 in Tazewell County as an Intensive Probation Officer.

    Dan has a Master of Arts (MA) in Counseling - Clinical Mental Health Counseling from Bradley University and a Master of Business Administration (MBA) from the University of Illinois.

    He served as the Chair of the Supreme Court Probation Policy Advisory Board, a member of the Illinois Judicial College, and a member of the Illinois Supreme Court Commission on Pretrial Practices and a member of the Illinois Judicial Conference.

    The Illinois Supreme Court named Judge Cara LeFevour Smith as the Director to lead Office of Statewide Pretrial Services (OSPS), the new operational structure for statewide pretrial services in adult criminal proceedings. Judge LeFevour Smith has served as a Cook County Circuit Judge since 2019, starting in the First Municipal District and more recently in the Juvenile Justice Division. She also served as chief policy advisor to Cook County Sheriff Tom Dart before joining the bench.

    The Honorable Robbin J. Stuckert retired after serving 20 years as a judge in the 16th and 23rd Judicial Circuits. Judge Stuckert Chaired the Illinois Supreme Court's Pretrial Implementation Task Force and previously served as Chair of the Illinois Supreme Court Commission on Pretrial Practices. She was awarded the 2021 National Association of Pretrial Services Agencies (NAPSA) Charles W. Daniels Judicial Leadership Award.

    Judge Stuckert was appointed Associate Judge for the Sixteenth Judicial Circuit in 2001 and was appointed Circuit Judge for the Sixteenth Judicial Circuit by the Illinois Supreme Court in 2003 and elected as a Circuit Judge in 2004. She was elected and served as Chief Judge of the Twenty-Third Judicial Circuit for a three-year term in 2015. While serving as a Judge in Dekalb County, Illinois, she presided over felony cases, Problem Solving Courts, and Bond Court.

    During her tenure as an Illinois Judge, she was a member of the Illinois Judicial College, served as Chair of the Illinois Judicial Bench Books Editorial Board, and served as faculty for judicial training on evidence-­based pretrial practices.

    Judge Stuckert received her B.A. degree from Northern Illinois University in 1987 and her J.D. degree from Northern Illinois University Law School in 1990.
