The realm of private contracts and landlord-tenant law has traditionally been a matter for state and local governance. However, a global pandemic and an executive agency changed all that on September 4, 2020. This presentation explores the legal origins and authority (or lack thereof) behind the CDC’s residential eviction moratorium and the status of current legal challenges to such an unprecedented action. We also will look at the present-day applications of the moratorium on both landlords and tenants in Arkansas and beyond, as well as the legal side-effects that may be on the horizon.
