7 "Reasonable Steps" To Defend Litigation Holds Under the New "Safe Harbor"

This learning lab analyzes the 2015 amendment to Rule 37(e) of the Federal Rules of Civil Procedure and the "Safe Harbor" in the rule which prevents a federal court from sanctioning an organization that uses "reasonable steps" to preserve evidence. You will learn what "reasonable steps" are, how to analyze a legal hold business process for compliance with reasonable steps, and how to implement process improvements to better protect an organization.
