Teleconference & Archive Bundle: Preserving the Integrity of the Estate Plan

As discussed briefly in one of last year's teleconferences, a provision in a trust instrument saying the trust is irrevocable may, today, be a mere minor impediment to making changes to the trust. Moreover, disgruntled spouses and beneficiaries may seek to launch a frontal assault on an estate plan that is not to their liking. While advising and designing estate plans for our clients, what steps can we recommend or take to ensure keeping our clients' carefully constructed plans intact? During this teleconference, we will discuss the following topics:

  • Drafting techniques to limit decanting and changes under the UTC and similar laws
  • Marital and cohabitation agreements
  • In terrorem clauses
  • Rescuing clients from their own improvidence
