WorkWise Law, PC wishes to clarify a statement made during
the webinar regarding the allowance of exemptions for Medicare and Medicaid
certified providers and suppliers that are under the CMS vaccine mandate.
Though it is true that an employee cannot “test out” of the vaccine mandate,
(i.e. test weekly instead of getting the vaccine), employees who qualify for an
exemption due a disability or a strongly held religious belief may continue to
work for their employer, subject to additional safety precautions being put in
place. If employees do not qualify for an exemption, employers should
work with counsel to find an appropriate solution, which may include placing
the employee in a 100% remote position without any patient or staff contact, on
an unpaid leave of absence, or termination.
