    Description

    CAP invites you to take advantage of a Litigation Education Retreat, offered at no charge as a part of your CAP membership. During this virtual event, you will learn techniques to alleviate the anxiety associated with being named in a lawsuit, what to expect during a typical medical professional liability case, and how using a few key communications tools in deposition can help you secure the most favorable litigation result.

    At the end of this activity, the learner should be able to:

    • Adapt at least 1 constructive tactic to cope with anger, anxiety, fear, depression, and the emotional fallout associated with a lawsuit.
    • Detect the effects of litigation on staff, family, associates, and the physician-patient relationship.
    • Differentiate the possible reactions to litigation based on the physician’s cultural/ethnic background.
    • Consider the effects of litigation on work and personal habits and how to cope day to day.
    • Illustrate the legal process and summarize the roles of the persons involved.
    • Integrate professionalism and competency when discussing medical care rendered.

    Event Schedule
    Managing Litigation-Related Stress
    9:00 a.m. – 10:00 a.m.
    Gain insights from Dr. Timothy Hofeldt, a psychiatrist specializing in physician wellness, on why being named in a lawsuit is so stressful. Learn constructive ways to cope with stress and deal with the anger, anxiety, and emotional fallout.

    Preparing a Strong Defense
    10:00 a.m. – 10:45 a.m.
    Robert Fessinger, Esq., an attorney from CAP’s dedicated defense law firm, Schmid & Voiles, will address what a plaintiff needs to prove in a medical professional liability lawsuit and how to work with your defense attorney to best present your side.

    Effective Communication Training
    11:00 a.m. – 12:00 p.m.
    Presented by litigation communications strategist Dr. Ken Broda-Bahm, this segment is designed to help you achieve a best-case outcome by reviewing key elements and techniques for effective communication. Learn how to demonstrate professionalism during both deposition and trial.

    • Timothy Hofeldt, MD, Psychiatrist

      Tim is a native Oregonian who has his clinical practice in Bend, where he resides. He received his medical degree from Albany Medical College and his residency training in psychiatry at Vanderbilt University Medical Center before engaging in fellowship training in the area of physician health and wellness. His professional work includes a clinical practice in general, adult and outpatient psychiatry and consultation. He works with healthcare organizations and professionals with an emphasis on physician litigation stress.

    • Robert Fessinger, Esq.

      Since 1991, Robert Fessinger has devoted his practice to the defense of doctors and hospitals throughout California. He has handled every aspect of medical malpractice defense litigation, from case inception through discovery and trial. He has successfully defended physicians in trials and binding arbitrations as well as handling class-action matters against healthcare providers.

      In 2005, Mr. Fessinger relocated his practice to the San Diego office of Schmid & Voiles. Sharing his knowledge and insight, he frequently is asked to lecture to claims specialists, doctors, and attorneys. Mr. Fessinger is a 1991 graduate of the University of the Pacific, McGeorge School of Law. As part of his legal training, Robert attended London’s Regents College, Inns of Court, where he studied under Supreme Court Justice Anthony Kennedy.

    • Dr. Ken Broda-Bahm

      Dr. Ken Broda-Bahm has provided research and strategic advice on several hundred cases across the country for the past 23 years, applying a doctorate in communication emphasizing the areas of legal persuasion and rhetoric. As a tenured Associate Professor of Communication Studies, Dr. Broda-Bahm has taught courses including legal communication, argumentation, persuasion, and research methods. He has trained and consulted in 19 countries around the world and is Past President of the American Society of Trial Consultants.

    • Douglas Shin, Esq.

      Douglas Shin, Esq. is general counsel for the Cooperative of American Physicians, Inc. Mr. Shin directs a legal staff and outside counsel to deliver legal solutions to this industry-leading medical professional liability company. Mr. Shin earned his Bachelor of Arts degree from the University of California, San Diego, and his law degree from Loyola Law School where he was a member of the Loyola Law Review.

      Mr. Shin began his career as a legal intern for the technology transfer team at Cedars-Sinai Medical Center and coauthored an article on the commercialization of intellectual property in central and eastern Europe. He also previously worked as a litigator, defending numerous clients in the general and medical malpractice liability, employment and healthcare arenas, including settlement of numerous matters and an arbitration.
