FERC’s recent proposed expansion of its “Duty of Candor” rule has raised
the larger issue of lawyers’ ethical obligations of candor in their
communications with courts, government agencies, third parties, and
beyond. This panel will explore those obligations, focusing on the ABA
Model Rules of Professional Conduct, state codes of professional
conduct, and legal ethics opinions. The panel will also explore
consequences for noncompliance and will conclude with a discussion of
practical tips and best practices for ethical compliance.
