Modern Land Trusts in Estate Planning
Present changes in land trust policy/law based on the book, MODERN LAND TRUST PRACTICE 2020 EDITION (IICLE ®, 2020) compared to the book, MODERN LAND TRUST PRACTICE 2020 EDITION (IICLE®, 2015). Legislative and case law update covering recent statutory and case law relating to land trust law and administration; specifically, the course will focus on changes in land trust law and administration covered in the IICLE Modern Land Trust Practice 2020 Edition. In particular, the class will cover the Land Trust Beneficiary Rights Act; inapplicability of the new Illinois Trust Code to land trusts; and recently decided cases regarding (i) the attachment of liens against land trust property; (ii) the homestead exemption when property held in land trust; (iii) death transfers and lapse issues; (iv) new legal and administrative requirements for the execution of land trust loan documents; (v) applicability of after-acquired title provision of Conveyances Act to property conveyed into trust; (vi) the validity of conveyances made by a beneficiary; and (vii) the distinctions between titleholder and owners of land trusts. Finally, the course will also cover emerging issues in land trust, such as Land Trust vs. TODI; use of land trusts as title fraud protection; online privacy issues; and the remote execution of land trust documents.

    David J. Lanciotti joined the Chicago Title Land Trust Company in 2001 and serves as Executive Vice President and General Counsel. His responsibilities include oversight of all aspects of the company, including trust operations and administration, business development, as well as all corporate legal and regulatory matters. He is licensed to practice law in the State of Illinois and in Federal District Court for the Northern District of Illinois. He is also the author of Land Trust Administration in Illinois (IICLE, 2009) and Modern Land Trust Practice w/ Forms (IICLE, 2015). He has been retained to provide expert witness testimony relative to the construction, interpretation and administration of land trusts. In addition, he is a board‐certified Continuing Legal Education Instructor and a frequent speaker at legal and banking seminars on land trust issues.
    David received his Bachelor of Arts degree from Purdue University and his Juris Doctorate, cum laude, from the Northern Illinois University College of Law.
