This CLE program will provide a brief exploration of the legal history of U.S. citizenship policy from colonial times through today, with a particular focus on the constricted pathways to citizenship for “unpopular groups.” Discussion topics include:
- English law and influence on U.S. citizenship policy
- Citizenship and the U.S. Constitution
- Early naturalization and immigration laws
- Dred Scott v. Sandford, the 14th Amendment, and United States v. Wong Kim Ark
- Pathways to citizenship for unpopular groups
- Modern-day threats to birthright citizenship.
