Don’t miss this half-day seminar that explores a number of key issues with the landlord-tenant relationship and how to navigate these challenges. Attorneys working in the practice area, as well as general practice lawyers, real estate practitioners, and bankruptcy attorneys, with intermediate practice experience who attend this seminar will better understand:
- When the new mandated Eviction Order took effect in the Cook County Circuit Court system and what it means for tenants, landlords, and municipalities where evictions are taking place;
- The eviction procedure, including notice, services of process, and the provisions regarding what constitutes a proper summons;
- The grounds for a lawful eviction and what constitutes an unlawful eviction;
- The tenant protections to be aware of;
- The special or mitigating circumstances that might delay the court proceeding, including landlord bankruptcy, foreclosure against the landlord, and the rights of tenants in such circumstances;
- The special procedures that may apply to evictions of entities that are tenants under commercial leases;
- How the court will evaluate and decide what is germane, and how to address this restriction when preparing your case;
- The distinctions between affordable residential housing that is owned by the government vs. private individuals;
- How tenants are impacted if HUD is the owner in a foreclosure proceeding;
- The stigma of eviction records and the pros and cons of sealing such records;
- The grounds for a tenant’s suit against the landlord; and
- How to integrate ex-convicts into their communities through programs that pave the way for access to basic services such as housing and employment.

Join us for an in-depth discussion regarding five distinct scenarios. The major issues are identified in each hypothetical, followed by a look at the problems that led to that situation. This interactive segment examines the potential claims and defenses of each party, how the facts could play out at trial, and the judicial interventions that are possible or likely. Mediation as a solution to the situation is also explored.
