BRIEFING: Title IX: The Final Rule

On May 6, 2020, the U.S. Department of Education posted to its website its final rule on Title IX related to sexual harassment. This represents the first comprehensive regulations issued under Title IX since 1975. As expected, the final rule addresses many of the topics previewed in the Department’s Notice of Proposed Rulemaking (NPRM), though there are instances where the final rule has been modified in ways that will be of interest to college and university counsel and administrators as they plan for implementation.
Candice Jackson, Deputy General Counsel for the U.S. Department of Education, has agreed to join us for a 1-hour, recorded briefing to apprise members of the content of the final rule. She will describe key features of the regulations and flag areas where they depart from the previewed content in the NPRM. Deputy General Counsel Jackson will describe the Department’s process in development of the regulations, highlighting content from the extensive preamble that may assist college and university counsel, as well as campus administrators, as they endeavor to implement the final regulations by the implementation date of June 30, 2020.
