Several months after the August 14, 2020 effective date of the Department of Education’s final Title IX regulations, colleges and universities continue to wrestle with a variety of implementation challenges, calling upon counsel and other campus administrators to develop policies and processes that are workable for their institutions and students. The sweeping changes and exacting detail of the regulations make this task a challenge, especially coupled with the overlay of the global pandemic that has fundamentally shifted educational delivery and operations on many college campuses. Adding to the complexity, an incoming Biden Administration is likely to take action in this area, possibly changing the landscape significantly over the coming months and years.
