Experience is the Best Teacher: Managing Risk in Internships, Clinical Placements, and Other Experiential Education Programs

Program Description
Whether it be an internship, service learning, a cooperative or clinical program, student teaching, a practicum, or study abroad, an experiential learning program offers students the ability to apply lessons learned in the classroom to the real world. Such opportunities can enrich a college student’s experience by stimulating intellectual curiosity and promoting civic engagement, cultural awareness, leadership, and career development. Additionally, survey results have repeatedly shown that employers prefer to hire candidates with some type of work experience. Given all of these factors, many colleges and universities strive to offer an ever-growing variety of experiential learning opportunities to their students. However, the development and maintenance of such programs does not come without risk.

Join us for this two-hour webinar which will discuss the legal implications of offering experiential domestic and international programs and provide college and university counsel and administrators with a roadmap for avoiding the legal pitfalls that such programs may present to an institution. Topics addressed will include:

  • Considerations for implementing experiential programs including liability for the institution, students, and experiential partners
  • Structuring partnership agreements; implementing compliance requirements; and ascertaining insurance needs
  • Student-related concerns such as determining a standard of care; providing accommodations; the application of federal anti-discrimination laws, FERPA, and FLSA; and managing student conduct and safety
  • COVID Considerations: providing accommodations in virtual programs; aligning remote programs with professional licensure requirements; modifying agreements with partners; requiring vaccinations for participation in programs; and returning to in-person programs
  • And more!
Who Should Attend?
This intermediate-level webinar will be of interest to in-house and outside counsel to colleges and universities, administrators in the fields of compliance and academic affairs, and others with responsibilities related to the development and oversight of experiential learning programs.
