On July 20, 2021, the U.S. Department of Education’s Office for Civil Rights (OCR) published Questions and Answers on the Title IX Regulations on Sexual Harassment, along with an appendix of policy provisions that align with the Department’s interpretation of Title IX and the accompanying regulations. This Q&A document “describes OCR’s interpretation of schools’ responsibilities under Title IX” and addresses topics such as the definition of sexual harassment, the appropriate standard for evaluating allegations of sexual harassment that occurred prior to the effective date of the 2020 amendments, the role of the advisor in Title IX proceedings, and “non-statement evidence”, among other things.
