Last week, the Department of Labor's Occupational Safety and Health Administration (OSHA) announced an emergency temporary standard to protect workers from the spread of COVID. Though a federal appeals court has stayed the ETS, its ultimate fate in the courts is unclear. The standard requires a broad range of employers to implement mandatory COVID-19 vaccination or frequent testing coupled with masking requirements. The standard is similar to the Executive Order issued in September related to federal contractors, and campus counsel are now called upon to parse through each of these federal directives, determining which applies and how to work through challenges related to them. In addition, several states have conflicting laws and we are watching closely the outcome of litigations regarding these federal mandates.
