The Supreme Court has agreed to hear a pair of cases challenging the use of race and ethnicity in university admissions at Harvard University (Students for Fair Admissions, Inc. v. President & Fellows of Harvard College) and the University of North Carolina (Students for Fair Admissions, Inc. v. University of North Carolina). While the questions presented in the cases are somewhat distinct, both ask the Court to overrule Grutter v. Bollinger and hold that institutions of higher education cannot use race as a factor in admissions.
These cases will be argued in the Court’s next term, which begins in October of 2022, and a decision is not expected until spring or summer of 2023. However, university administrators are well-advised to start planning for the future now, given the complexity of the work. While we cannot predict how the Supreme Court will rule, college and university counsel, enrollment managers, and other campus leaders are considering how to improve upon current practices and consider new initiatives in order to be prepared, no matter the result of the ruling.
