BRIEFING: Department Of Labor's Notice of Proposed Rule Changes on Overtime Exemptions

On August 30, 2023, the U.S. Department of Labor released its proposed new rule on the “white collar” overtime pay exemptions, which would significantly increase the salary an employee must receive to qualify for being exempt. The proposed rule also increases the salary threshold for highly compensated employees (HCE) and includes automatic updates, bumping up the threshold with inflation every three years.
