“I can yell ‘fire,’ right….?”: The Practicalities of Implementing the Laws and Policies Governing Employee and Faculty Speech on Campus

  •  In addition to the typical issues that arise on a bustling academic campus, a contentious election season approaches. Participants in this advanced session will dive into the nuances of the legal framework underpinning speech on both private and public campuses.
  • Participants will learn how to apply the legal framework to real world situations and learn of the practical realities of operationalizing institutional policies.
  • These real world situations will aim to highlight and address the trickier aspects of: messaging to the campus community about speech on campus (or at institution-sponsored activities), providing guidance to senior administrators, and the collision of “free speech” with academic freedom and an institution’s other legal obligations (such as compliance with Title IX and Title VI).
