(CDR-3896) Strategies for Testifying Experts to Handle Attorney Challenges

Abstract: While developing the expert analysis report is a significant task, testifying about the conclusions drawn from that report can be even more stressful and carries the risk of undermining the report or possibly even disqualification as an expert. Most experts take the time to examine potential mistakes or weaknesses in their approach to testimony, but every attorney has their own approach to questioning the expert.

The authors believe that developing a strategy to address the typical types of challenges from the opposition attorney improves an expert’s testimony and subsequent success. This paper is designed to provide some of the more difficult challenges that an expert could encounter from the opposition attorney, outside of the arcane forensic analysis details.

The authors have significant experience in forensic schedule analysis claims and testimony, from depositions to arbitration or litigation, and will include a construction litigation attorney to help identify challenges and compile or devise appropriate strategies. This session should be valuable to experts at all levels of testimony, from beginners to deeply experienced experts.
