Beyond FERPA: How to Find State Laws and District Policies on Student Data Privacy

Program Overview
The National School Health Data Set invites nurses to submit data that is de-identified in accordance with law and school district policy. This webinar provides an overview of the National School Health Data Set and briefly reviews applicable federal privacy law. We will then explore resources for finding summaries of state privacy laws, as well as questions that nurses can ask to find district data privacy policies. The webinar will also review a checklist that is designed to assist school nurses with identifying and complying with state and district data privacy policies.

Learning Outcomes

As a result of participating in this educational activity, learners will be able to:
  • Understand how FERPA defines PII and what constitutes de-identified data under FERPA.
  • Understand the different types of state privacy laws that might affect the ability of the school nurse to share student health information.
  • Identify sources of state privacy law and readily find such laws.
  • Understand the role of school district privacy policies in the larger framework of student privacy regulations and how to find them.

Intended Audience
This continuing education program is a knowledge-based activity developed to meet the educational needs of registered nurses who are interested in child and adolescent health.
