The Unauthorized Practice of Law

This Seminar will focus on avoidance of the unauthorized practice of law when conducting real estate closings and insuring titles. The existing unauthorized practice rules as promulgated by the Virginia State Bar will be examined, along with applicable statutory and case law.

The seminar will present realistic hypothetical scenarios and examine the questions of unauthorized practice that may be encountered as well as methods to avoid potential pitfalls. In these scenarios, the role of the settlement and title agent will be discussed in light of the provisions of Consumer Real Estate Protection Act (recodified under Virginia Code Section 55-525.16 through 55-525.32) and Legal Ethics Opinions bearing on these matters.
